These Terms of Service (“Terms”) govern your access to and use of our website https://www.pemagear.com (the “Site”) and the purchase of products from Pemagear, a brand operated by Pemadova LLC, a limited liability company registered in the State of New Mexico, United States (“we”, “us”, or “our”). By accessing or using the Site or placing an order, you agree to be bound by these Terms.

1. Use of the Site

You must be at least 18 years old or the age of majority in your jurisdiction to use the Site or place an order.
You agree to use the Site only for lawful purposes and in accordance with these Terms.
You are responsible for maintaining the confidentiality of your account and password and for all activity that occurs under your account.
You agree not to use the Site or any of our products in any way that infringes on the intellectual property or other rights of third parties.

2. Products and Orders

All products are custom-made to order (print-on-demand). Each item is individually produced after your order is placed. By placing an order, you agree:

To provide accurate shipping and billing information.
That production begins shortly after payment confirmation. Orders may be canceled for a full refund within 24 hours (weekdays) or 48 hours (weekends/holidays) of placement. After this window, orders cannot be canceled or modified.
That product images on our website are digital mockups. Slight variations in color, print placement, or scale are normal and do not constitute a defect.
That orders are fulfilled by trusted partners in the United States, China, or Vietnam, depending on product type and shipping destination, and the country of origin is indicated on the shipping label.

We reserve the right to refuse, cancel, or limit any order at our discretion — including, but not limited to, orders that appear fraudulent, contain pricing errors, or violate these Terms. If your order is canceled by us, you will receive a full refund.

3. Pricing and Payment

Prices are listed in USD and are subject to change without notice. You agree to pay all charges, including applicable taxes, duties, and shipping fees. We use secure third-party payment processors and do not store full credit card details. In the event of an obvious pricing error, we reserve the right to cancel any affected orders, even if confirmed, and issue a full refund.

4. Intellectual Property

All content on the Site — including designs, images, text, logos, graphics, and trademarks — is owned by Pemagear / Pemadova LLC or our licensors and is protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, modify, transmit, or create derivative works from any content on this Site without our prior written permission.

5. IP Infringement & DMCA Policy

We respect the intellectual property rights of others and require our users and partners to do the same. If you believe that any content on our Site infringes your copyright, trademark, or other intellectual property rights, please submit a written notice to support@pemagear.com including:

Your full name, address, phone number, and email;
Identification of the copyrighted work or trademark you believe has been infringed;
The URL(s) or specific location of the allegedly infringing material on our Site;
A statement that you have a good-faith belief that the use is not authorized by the copyright/trademark owner, its agent, or the law;
A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the rights owner;

Upon receipt of a valid notice, we will investigate and, where appropriate, remove the infringing material promptly. We may also terminate the accounts of users found to be repeat infringers.

6. User Conduct

You agree not to:

Use the Site for any unlawful purpose or in violation of any applicable laws.
Upload viruses, malware, or any malicious code.
Interfere with the Site’s functionality, security, or performance.
Attempt to gain unauthorized access to our systems, servers, or other user accounts.
Use automated tools (bots, scrapers, crawlers) to access the Site without our written permission.
Impersonate any person or entity, or misrepresent your identity or affiliation.

7. Limitation of Liability

To the fullest extent permitted by law, Pemagear and Pemadova LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or purchase of products — including but not limited to lost profits, lost data, or interruption of service. Our total cumulative liability for any claim shall not exceed the amount actually paid by you for the product in question.

8. Disclaimer of Warranties

The Site and products are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or free from harmful components.

9. Indemnification

You agree to indemnify, defend, and hold harmless Pemagear, Pemadova LLC, and our officers, employees, and partners from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from: (a) your breach of these Terms; (b) your misuse of the Site or products; or (c) your violation of any third-party rights, including intellectual property rights.

10. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, pandemics, war, strikes, government actions, carrier failures, customs delays, or internet outages.

We reserve the right to suspend or terminate your access to the Site, cancel any pending orders, or close your account at any time, without notice, if we reasonably believe you have violated these Terms or engaged in fraudulent or unlawful activity.

12. Changes to Terms

We may update these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Site after any change constitutes acceptance of the new Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States and the State of New Mexico, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved through good-faith negotiation first; if unresolved, exclusively in the state or federal courts located in New Mexico, United States.

14. Severability & Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, Shipping Policy, Refund & Return Policy, Payment Policy, and Disclaimer, constitute the entire agreement between you and Pemagear regarding your use of the Site.
